SHK Enterprises, LLC, doing business as Saymore, ("we," "us," "our," or the "Company") operates an online platform (the "Platform") on https://saymoreco.com/ (the "Website") that provides Users ("you" and "your") with two primary services: (1) a mental-health-focused social media service ("Social Media Services"); and (2) a mental health matching services, which connects certain Registered Users with licensed mental health Providers ("Matching Services"). This Privacy Policy describes how we collect, use, share, and protect personal information in connection with your use of the Website and Social Media Services and Matching Services (collectively "Services").
1.1. By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please do not use the Platform or Services. This Privacy Policy is incorporated by reference into our Terms and Conditions.
1.2. We are committed to handling your personal information, including sensitive health-related information, with the utmost care and in compliance with applicable federal and state law, including the Health Insurance Portability and Accountability Act ("HIPAA") where applicable.
1.3. The Company does not provide medical, psychological, psychiatric, counseling, therapy, crisis-response, or other licensed health care services. The Company does not diagnose, treat, prescribe, provide clinical advice, or determine whether any particular Provider is clinically appropriate for you. Any mental health professional identified through the Service is an independent third party, and any relationship you form with a Provider is formed, if at all, directly between you and the Provider.

The following defined terms apply throughout this Privacy Policy:
2.1. "User" means any individual who accesses or visits the Website, whether or not they have created an account. All visitors to the Website are Users.
2.2. "Registered User" means any User who has created an account on the Website.
2.3. "Provider" means a licensed mental health professional, including but not limited to a licensed mental health counselor (LMHC), licensed clinical social worker (LCSW), licensed marriage and family therapist (LMFT), or licensed professional counselor (LPC), who is a Registered User and purchased a Subscription to access Matching Services.
2.4. "Subscription" means the paid access plan purchased by Providers to participate in Matching Services. Only Providers purchase Subscriptions; access to Services for Users and Registered Users does not require a Subscription.
2.5. "Content" means any text, audio, video, photographs, graphics, and other materials posted, uploaded, or transmitted through the Website by a Registered User.
2.6. "Match Records" means records of questionnaires received, potential Providers identified, match results delivered, introductions or contact information transmitted, consents obtained, and related administrative records generated through Matching Services.

Our Services are not directed at and are not intended to be used by individuals under the age of 18. We do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, do not use our Services or provide any information to us.

8.1. To the extent any information you provide constitutes protected health information ("PHI") under HIPAA, such information will be handled in accordance with our HIPAA Notice of Privacy Practices ("NPP"). The NPP governs the use and disclosure of your PHI and, where it conflicts with this Privacy Policy, the NPP shall control.
8.2. All information collected from you which does not constitute PHI but constitutes Consumer Health Data, will be handled in accordance with our Consumer Health Data Privacy Policy ("CHDPP"). Where the CHDPP conflicts with this Privacy Policy, the CHDPP shall control.

This Section applies to Registered Users who also identify as Providers and purchase a Subscription to participate in Matching Services. Providers are subject to all applicable provisions in the Sections entitled "Users" and "Registered Users" along with the additional provisions described in this Section.

9.2. Subscription Terms. Only Providers purchase Subscriptions. A Subscription grants a Provider access to Matching Services for the purpose of being matched with and providing services to Registered Users seeking Matching Services. Subscription billing, renewal, and cancellation terms are governed by the Terms and Conditions and any applicable agreement with the Company.

Credit card and payment processing is managed by our third-party payment processing provider. Any payment information you submit is collected and stored by our payment processor. By providing payment information, you authorize our payment processor to collect and process such information on our behalf. 17.2. How We Use Cookies and Web Beacons. We use our own cookies and web beacons to deliver a faster and safer experience, monitor and analyze usage, comply with laws, and, if you opt in, for advertising purposes. We use automatic data collection technology when you visit the Platform to record information that identifies your computer or device and to collect Usage Information, including: operating system; IP address; browser type and language; referring and exit pages and URLs; date, time, and amount of time spent on particular pages; and what sections of the Platform you visit (collectively, "Usage Information").

17.4. Marketing Emails. You may opt out of receiving marketing emails from us at any time by selecting the unsubscribe link located at the bottom of any marketing email communication. Please note that you cannot opt out of certain service-related or billing communications.

If you opt in to advertising cookies and web beacons, some Visitor Data (excluding data from your logged-in, active therapy sessions and any PHI) may be shared with advertising partners so that we can deliver relevant advertisements on third-party properties.
18.2. If you do not wish to receive advertising, you may withdraw your consent to advertising cookies at any time through your account settings or our opt-out instructions page. Our website is also designed to honor "Do-Not-Sell" or "Do-Not-Track" signals where required by applicable law.

We encourage you to protect your account by: (i) choosing a strong, unique password; (ii) changing your password frequently; (iii) logging out of your account when using shared devices; and (iv) notifying us immediately of any unauthorized use of your account.
